Terms of Service
These Terms of Service ("Terms") govern your use of the MercariBoost Chrome extension and related services ("Service"). By installing or using the Service, you agree to these Terms. If you do not agree, do not install or use the Service.
Free-launch version: this document currently covers the free, no-payment phase. The subscription / payment / refund / cancellation sections will be re-added when the paid tier launches. Until then, MercariBoost is free with no purchases, no signup, and no recurring billing.
1. The Service
MercariBoost is a productivity Chrome extension that assists Mercari sellers in relisting items more efficiently. The Service is provided by lesteroc15 ("we", "us"). We are not affiliated with, endorsed by, or sponsored by Mercari Inc.
The Service is currently offered free of charge. We do not collect payments, do not require account creation, and do not store user data on any server we control. All listing data stays in your browser's local storage.
We may, in the future, introduce paid tiers. Any such change will be announced through the extension's update notes and on the listing page at least 30 days before taking effect, and the version of the Service you installed before any pricing change becomes available to you at no cost for as long as we operate it.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement. You are responsible for any activity that occurs through your use of the Service.
3. Mercari Compliance — Your Responsibility
Important: This is a productivity tool that automates user-initiated actions. You are solely responsible for ensuring your use of the Service complies with:
- Mercari's Terms of Service, including its Prohibited Conduct policy
- Mercari's Seller Agreement and any other applicable Mercari policies
- All applicable laws and regulations
Mercari's terms prohibit the use of automated tools to access its service. By using MercariBoost, you acknowledge that:
- You are using the Service at your own risk
- Mercari may, at its discretion, suspend or terminate your Mercari account, withhold funds, or take other actions against accounts that use third-party automation
- We are not responsible for actions taken by Mercari against your account
- We are not liable for any losses, damages, or fees you incur as a result of Mercari enforcement actions
We design the Service to mimic natural human pacing (randomized delays, conservative intervals, no background scraping) but cannot guarantee Mercari will not detect or take action against automated activity.
4. Acceptable Use
You agree not to:
- Use the Service in violation of any law or regulation
- Use the Service to engage in fraud, deceptive practices, or sale of counterfeit goods on Mercari
- Reverse-engineer, decompile, or attempt to extract source code from the Service beyond what is permitted by applicable law
- Resell, sublicense, or redistribute access to the Service
- Use the Service for any purpose other than its intended use as a Mercari seller productivity tool
- Use the Service in a manner that could disrupt Mercari's service for other users
We may terminate your access to the Service if we believe you have violated these terms.
5. Service Availability
We strive to keep the Service operational but do not guarantee uninterrupted availability. Mercari's website may change in ways that temporarily break extension functionality. When this happens, we commit to:
- Acknowledge the issue within 24 hours
- Ship a fix within 24–48 hours when reasonably possible
- Communicate via in-extension notification when applicable
6. Intellectual Property
The Service, including its code, design, copy, and branding, is owned by lesteroc15. You receive a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You may not copy, modify, or distribute the Service.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement.
We make no warranty that:
- The Service will be uninterrupted, error-free, or secure
- Use of the Service will increase your Mercari sales or visibility
- Mercari will not change its platform in ways that affect Service functionality
- Your Mercari account will not be affected by your use of automation tools
8. Limitation of Liability
To the maximum extent permitted by law, our total cumulative liability arising from or related to these Terms or the Service is limited to $100. (When the Service is free, no amount has been paid; this $100 floor is the maximum aggregate liability.)
We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost sales, lost data, or losses caused by Mercari enforcement actions, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold us harmless from any claims, losses, or damages arising from your use of the Service in violation of these Terms, applicable law, or Mercari's terms.
10. Modification of Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Material changes (including, in the future, introducing paid tiers) will be communicated via in-extension notification at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.
11. Termination
We may suspend or terminate your access at any time for violation of these Terms or for any reason with reasonable notice. Upon termination:
- Locally stored data remains on your device until you uninstall the extension
- Sections that by their nature should survive termination (Disclaimers, Limitation of Liability, Indemnification, Governing Law) survive
12. Governing Law and Disputes
These Terms are governed by the laws of Texas, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Texas, except where applicable law requires otherwise.
You and we each waive any right to a jury trial and to participate in a class action.
